§ 10-3. Wetlands book.

  • (a)

    A wetlands book is hereby established in the office of the clerk of courts.

    (b)

    The state department of environmental regulation and United States Corps of Engineers shall file in the wetlands book a description of all properties located in the county which are subject to the regulation of such agencies because of wetland status.

    (c)

    The state department of environmental regulation and United States Corps of Engineers shall file amendments to the descriptions as required by change in statute, regulation, or characteristics of land.

    (d)

    Jurisdictional determinations issued by the United States Corps of Engineers or department of environmental regulation may be recorded in the wetlands book by the owner of the applicable property.

    (e)

    The state department of environmental regulation and United States Corps of Engineers do not recognize the authority of the county to adopt this section. Such agencies will continue to implement their regulations and statutes although they have not complied with the terms of this section and the Constitution of the United States.
