§ 10-29. Same—Revocation procedure.

  • (a)

    Authority. The board of county commissioners, following notice and a hearing, shall have authority to revoke the permit authorized by this article where:

    (1)

    The license holder has been convicted of violating any applicable provision of this article.

    (2)

    The license holder has been convicted of violating either state or federal regulations or statutes governing the activity engaged in by the license holder.

    (b)

    Procedure. Prior to revoking the permit authorized by this article, the permit holder shall be given notice of intent to revoke the holder's permit, which notice shall set forth a statement of the reasons why such action is being considered. Within 30 days of such notice, a hearing shall be held at which the permit holder shall be given an opportunity to respond to the notice. Following such hearing, the board of county commissioners shall issue an order setting forth findings of fact and conclusions, and a decision regarding the revocation.
