§ 10-57. Exemptions.

  • The board of county commissioners will exempt any otherwise regulated material from the requirements of this article where either the state department of environmental regulation or the United States Environmental Protection Agency has determined that the waste, in the quantity and/or solution handled or the conditions under which it is stored, does not present a significant actual or potential hazard to human health or the environment. The board of county commissioners, even in the absence of such a determination by the state department of environmental regulation or the United States Environmental Protection Agency, may independently exempt any otherwise regulated material where it has been demonstrated that the waste, in the quantity and/or solution handled or the conditions under which it is stored, does not present a significant actual or potential hazard to human health or the environment.
