§ 10-66. Violations, enforcement, remedies.

  • (a)

    Violations of this article may be referred by the department to the county attorney.

    (b)

    Any person who violates any of the provisions of this article or who fails, neglects or refuses to comply with any order or notice given in pursuance and by authority of this article shall be punished as provided in section 1-6.

    (c)

    It is hereby found and declared that a violation of the provisions of this article constitutes a public nuisance and an irreparable injury to the citizens of the county, and the county may institute a civil action in a court of competent jurisdiction to seek injunctive relief to:

    (1)

    Enforce compliance with this article or order;

    (2)

    Enjoin any violation of this article;

    (3)

    Prevent injury to the soils and water, including animal, plant and aquatic life in the county; and

    (4)

    Protect human health, safety and welfare caused or threatened by any violation.
