§ 14-1. Nuisance growth of kudzu.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Kudzu (Puerraria lobata). A large trifoliate-leaved, semi-woody, trailing or climbing perennial vine that belongs to the legume family.

    Person. Any individual, business or corporation.

    (b)

    No person who on or after December 12, 1996, owns property on which kudzu is located, shall allow such kudzu to grow onto adjoining properties, unless the adjoining property owner consents to such growth.

    (c)

    Any person who fails to prevent such kudzu from growing onto adjoining properties shall be guilty of a civil infraction, punishable as specified in section 1-6.5 of the County Code.

    (d)

    Any kudzu as it is located on December 12, 1996, shall not be affected by the provisions of this section.

    (e)

    Any affected person may seek injunctive relief to require that the provisions of this section are complied with. The county shall have no obligation to seek such injunctive relief.
