§ 18-67. Indemnity.

  • All holders of permits issued pursuant to this article shall, at their sole cost and expense, fully indemnify, defend, and hold harmless the county, its officers, boards, commissions and employees against any and all claims, suits, actions, liability and judgments from third parties for damage which may be the result of willful, negligent or tortious conduct or operations arising out of the business of collection, transportation and disposal of solid waste, whether or not the act or omission complained of is authorized, allowed or prohibited by this article.

    The permit holder shall pay all expenses incurred by the county, including attorney's fees and other costs of litigation, in defending itself with regards to all claims and action mentioned above.
