§ 6-59. Exemption.

  • The licensing provisions of this article shall not be applicable to:

    (1)

    Salesman representing wholesale houses or distributors who sell to local retail merchants from catalogues or samples.

    (2)

    Sales of items which have been personally fabricated or handcrafted by the seller thereof.

    (3)

    Sales of goods or merchandise purchased with donated funds or donated by the owners thereof, the proceeds whereof to be applied to any charitable or philanthropic purpose.

    (4)

    The conducting of a sale of privately owned, used merchandise at garage or yard sales on premises owned or rented as a residence by the seller of such goods.

    (5)

    Sales of goods or merchandise at festivals, gun shows, celebrations or other special events sponsored or permitted by the appropriate governing body or authority.

    (6)

    The sale of farm, grove, horticultural, floracultural, tropical piscacultrual, or tropical fish, farm products or products manufactured therefrom, except intoxicating liquors, wine, or beer.

    (7)

    Where anticipated sales and stock on hand are anticipated at or valued at less than $1,000.00 in any given business day.

    (8)

    The sale by an individual of items personally owned by said individual, not in conjunction with a commercial enterprise.
