§ 7.00.00. Purpose.

  • The purpose of performance standards is to control multifamily residential, commercial and industrial uses; to prevent potential nuisances; to be measured factually and objectively; to ensure that all uses provide methods to protect the community from hazards and nuisances which can be prevented through processes of control and nuisance elimination; and to protect industries from arbitrary exclusion or persecution based solely on the nuisance production by any particular type of similar use in the past.

    7.00.01. Application of standards.

    As of the effective date of this ordinance:

    A.

    Any use established or changed to, and any buildings, structures or tracts of land developed, constructed or used for any permitted or permissible principal or accessory use shall comply with all the performance standards herein set forth for the district involved.

    B.

    If any existing use or building or other structure is extended, enlarged, moved, structurally altered or reconstructed; or any existing use of land is enlarged or moved, the performance standards for the district involved shall apply with respect to such extended, enlarged, moved, structurally altered or reconstructed building or other structure or portion thereof.

    C.

    After the effective date of this regulation, all new uses, buildings or other structures shall comply with the performance standards herein set forth for the district involved.
